madden%2009 EA to be sued over Madden?The gaming giant is currently bracing for a lawsuit that will be hitting EA over its Madden franchise. The spot of contention comes from the fact that the NFL uses the likeness of retired players (notably for its throwback teams) who as of now aren’t getting any of the royalties for the use of their likeness.

Retired players have already won a a ruling against the NFL Players Association to the tune of $28 Million dollars over the use of their likenesses in videogames. Now the players set their sites on EA.

“Madden collected over $100 million in royalties while paying the retired NFL players used in those games absolutely nothing,” wrote Bernie Parrish, a former Cleveland Browns defensive back.

“”In my opinion, Madden should have been included in our licensing suit against the NFLPA and so should EA,” Parrish continued.

Parrish was among those that were in the lawsuit against the NFL Players Association in which it was found that the Association had purposely cut out paying money to retired players when including them in licenses for “vintage games”.

This situation is very serious to Parrish who wants the players of the former lawsuit to donate $1,000 a piece to contribute to a “war chest” to fund the impending court battle.

He is aiming high, as according to Parrish former players “stand to recover [hundreds] of millions of dollars over the coming years for their children and grandchildren.”
